PART 1: ORDER CANCELLATION BY YOU, THE CUSTOMER
(A) In the event of cancellation or variation of an order, for whatever reason, the Company shall be entitled to charge cancellation fees as set out hereunder:
NB: Cancellations and Refunds: Notice of cancelation must be made in writing (e-mail acceptable) and refunds will be issued based on number of days, after delivery, that the order is cancelled as per the schedule below;
- from the time of order to time of reciept - 10% of payment is forfeited.
- 1-5 days, 25% of total payment forfeited;
- 5-14 days, 50% of total payment forfeited;
- 14-31 days, 75% of total payment forfeited;
- 32 days or above, 100% of total payment forfeited.
The liability to reimburse the Company (Or the Individual) for the cancellation fees, administration fee and the like shall, in no way, limit or restrict the general rights of the Company to collect damages for breach of Contract.
(B) If you are unavailable, as scheduled, at the time of delivery, Ismarwa shall be entitled to treat your order as canceled without having given Ismarwa any notice, and the provisions of Conditions (A) above shall apply.
(C) Any request to amend or change an order once it has been confirmed may be accommodated subject to stock availability. If Ismarwa is able to assist, an administrative fee of 10% of the total value per change may be assessed. These fees will be added to your final invoice.
(D) No refunds are given in these scenerios;
(1) for substitution of facilities after dispatch,
(2) for orders amended after dispatch,
(3) for circumstances arising beyond the control of Ismarwa, necessitating alternative arrangements being made to ensure the safety and / or successful delivery, or
(4) where applicable, if you do not collect any Goods(s) without notifying Ismarwa,
(E) Non-payment for the Goods ordered In the event that the Company has not received payment in full before dispatch of the Goods, then the company reserves the right in its absolute discretion to withhold all or any of the products ordered and to recover from the Customer all cancellation fees which they are entitled to charge as per Conditions (A) above. The Company shall not be required to notify the Customer, prior to the delivery of Goods, that the Goods or any part of the Goods will be withheld.
PART 2: ORDER CANCELLATION / ALTERATION BY US, ISMARWA
We reserve the right to cancel any order. Should this happen we will arrange an alternative choice for you, with paying or receiving a refund regarding the price difference or a full refund of all sums already paid. If we have to stop the delivery after dispatch because circumstances of acts of God or force majeure, we cannot make any refunds or give you any compensation for unused goods or any additional costs on your behalf. If any already paid service or transportation has been canceled by Ismarwa Investments Ltd, you will get the whole refund for all sums paid to Ismarwa Investments Ltd for the canceled order. You will get a refund for canceled orders by Ismarwa Investments Ltd within 14 days after cancellation and within 30 days for canceled orders by sub-contractors or after receiving money from sub-contractors.
Subject to refund are all sums paid by customers minus the respective PSP charges. Also any unused portions of your order after dispatch are not subject to a refund. No refunds will be paid, if the client wishes to stop the delivery after dispatch or does not wish to use any goods already paid for.
We reserve the right to alter any arrangements or cancel a scheduled operation should it be obligatory in case of air schedule, poor road conditions, weather conditions, security matters, border closures or any other reason beyond our control. The local conditions in Africa are not always predictable and from time to time delays and diversions from the planned route can happen. We will do our best to please you and minimize inconveniences but cannot be responsible for matters clearly beyond our control.
